What is the name of your state? Ohio
My son and I have a power of attorney through the state that was brought into law last summer and is filed with the court. He has legal custody of his son, my grandson, who is living with my husband and I. It gives me the authority to deal with his school and medical providers etc. but not legal custody.

Has anyone else used this new law?
I am wondering if anyone has had to file a second one, as this is in effect for a year (or until the child leaves the home or the parent revokes it). We may be doing this a second time before school resumes in early September, and the law states that there will be a hearing to determine if a second one is in the child's best interest.

I don't know anything about the law you are referencing but I would like to know where your son is? Does he live with you as well? If so, then why would you be pursuing further legal custody or guardianship?

If he has disappeared and you are being fully responsible for the childs upbringing then you should be filing for legal custody based on abandonment and unfitness.

Where is exactly is the childs mother?

My son and the boy lived with us since Mom gave Dad custody in 2001.
Last summer son moved out, about 15 minutes away.
Mom is half an hour away. Neither see that much of him.

GS's school needed this POA because it is filed with the court. I guess it's the next best thing to legal custody.

If there is a hearing for a second POA, one of the options the court has is to treat it as a petition for custody and grant it to us.

If anyone is interested, here is a link to the law:
