IAAL, can she appeal this and get another judge to hear the case? And would this help or be a waste of time?

A-S, How's Mel, as if it needs to be asked. Having the gorilla attorney probably wouldn't have helped. even killers in prisons have been given the time with the kids. I'm so sorry the outcome couldn't have been better. Relationships have been broken for far less. As much for my own, I scream when I see this stuff. Not to frighten you any more, and I'm sure you've thought this too, but, the judge has no control, once he would leave the states with the babies. Why are judges so arrogant as to believe that a man who couldn't think rationally enough to keep from physical harm of his family think that person will be a saint, and comply with ANY order? Pull---ease.

Well, it was a rough road, and all you can do is try. I wish the hearing would have turned out better.

Anyway, to answer your question, although the State has jurisdiction, the way it works in California is probably the same way it works in OK; and that is, when a case has been filed in a particular County, that's where the proceedings of a filed case must stay - - unless someone can find legal grounds to transfer an action to another County.

As to Paula's question, from the description of what happened, I don't see any grounds for an appeal. A judge has wide "discretion" in Family Law cases, and unless there is an "abuse of discretion", there wouldn't be any grounds for an appeal.
