Yes, you have the right to file for divorce.

A 10 year marriage might get you some spousal support. Speak with a local attorney asap.

I missed where she stated her income was significantly different than his.

Could be that HE is the one with less income - all we know is that the poster is female, and I sure hope that does not mean we presume her less financially capable than he.

Why would ANY presumption about spousal support be made based soley on gender?

Given that SHE made no mention of HER income but made a point of mentioning that he owns HIS own business, it's not too much of a reach, surely?

I suggest you jump back down off of your soapbox. We don't want you to trip over your own bias, now do we?

You have a right to get a job and support yourself. You have a right to make your own money. You have a right to half the marital equity in the house. You have a right to half the marital assets and half the marital debt. There is NO guarantee of spousal support nor any entitlement to it just because you were married for ten years.

Do you work?
Was the home purchased before or during your marriage?
Is the business successful? Are there any co-owners?
Is hubby paid a salary from his business? What income does hubby claim on his income tax?
What is the income difference between you and hubby?
Are you receiving CS from your child's parent?
Do you have any savings to access for an attorney or an attorney consult?

Ok so if you left your husband would you be asking where to find what HIS rights are?? If YOU blindsided him for 2 years would that make a difference??

If you had the small business, the house were in your name and he had an 18 year old still in school, would you give a crap about his well being??

Fortunately this works BOTH ways. At least it's SUPPOSED to.

What is the relevance of having an 18-year old, still in school, who is not his child have to your supposed "rights."

The 18-year old adult has the right to aid in their own support. You have the right to find a source of income and live your life, just as he does.
