Does any one have any idea on what needs to be done to have an old child support Judment set aside? The judgment was from 96' When my husbands ex stated he wasn't paying child support which he was but didn't keep track of old money order receipts. He has paid by allotment since then. My husband has paid the full amount of the judgement back but since talking to a lawyer about a current case cause she is now pulling the same thing again and received state aid, the lawyer said since he was never served the court should not have garnished his wages and under the 'Soldiers and Sailors Civil Relief Act' they were supposed to have a lawyer represent him because he could not be there. We need to have the judgment quashed so he can get a DNA test through the court of CA. Does any know about how much a Kansas lawyer would charge to quash the judgement? We are already broke from paying our current lawyer which we have to make payments on the retainer and can't really afford to pay another one. Sorry for rambling I am just stressed over this whole issue. Any input would really help!!
