What is the name of your state (only U.S. law)? Georgia
more that 7 years ago I filed chapter 13, 36 month plan, and paid on time all but the last 2 payments. There was a serious medical issue and I asked the Trustee to dismiss the 13 and she agreed that it should be, ad did so. Now, it's 7 years later, two of the credit bureau's automaticly removed the chapter 13 from my file, but one, equifax refuses to remove it saying that if it was discharged and not dismissed it would be removed. I thought it was the law the it be removed after the 7 years. should there be any difference, and what can i do about it? am i incorrect?
thanking you in advance,
vietnamvet

Cases under title 11 [United States Code] or under the Bankruptcy Act that, from the date of entry of the order for relief or the date of adjudication, as the case may be, antedate the report by more than 10 years.
from what I understand, either a chap 7 or 13 can be reported for up to 10 years. It appears that a chap 13 is often removed after 7 years. While the statement above also appears to state it is from the date of discharge, other sources I have read state that has been clarified to actually mean from the date of filing. I have not verified that though.

Apparently Equifax does report a chap 13 for the full 10 years typically.
