What is the name of your state? Ky.

If heirs inheriate property and the property goes into all of the Heirs names, the majiority wants to sell, does the majirity rule?

Of course there was no will stating what or which piece of land/property goes to who. So the Attorney says the land/property has to be put into all three of the heirs names and then divided or sold or whatever.

I just want to know if the majority ruls on if one decided he doesn't want to sell, and all the others want to sell?

Hummm i could have sworn the Attorney said that? I was going to call and make sure that is what she said, but I thought about the forum too and thought I would ask here too.

So if two want to sell and one doesnt then this ties up the property huh? Or could a judge rule on this. Can you please enlighten me a little more on situation like this?

Research "partition" Those heirs who wish to sell can bring an action for Partition, which can result in an order that the properties be sold.

ok answer this... now that the property is in all three of the childrens names and i own 1/3 of it can i charge rent to my brother and his girl friend for living in my third.. I sure will be glad when all thisis over.. been a nightmare would have never thought I would be going through such a mess.. but thanks alot..

no because, (I assume) your brother is also an owner. Sell the place either to one of the others or through partition.

If a partition is set before the judge because one of the sublings wont agree to sell does this mean if the judge hear's the case he decides to hand this over to the commisioner for a sale of the property? If so he gets a percentage?

Also, we want to have the one bad brother removed from the property how can we go about doing this ?

Almost there

Brother is stillin the house cause I have had a hard time coming up with the money for a lawyer. I had a terrible surgery and unable to work that is why. We are working on it tho slowly and I hate it, but sometimes next two weeks we are hiring a lawyer for this crap. Please do not fuss at me if I didn't post this correctly, gently guide me through the process sincee I don't post often I am not sure how to tag on to my other post. If I am doing it correctly this time woo hoo, but for some reason I doubt it. lol..

I have a question the brother is growing pot on the land we all own. If I report this to the proper people.. police, in court can the Government take the land. I know this use to be the law, but heard they can't do that now. Could someone pls explain this to me.
