I live in Oklahoma. I purchased an item using an online auction from a seller who resides in Ohio. I used a 3rd party payment service with my credit card. The item was never sent and the seller has not responded to my multiple contact attempts. I reversed the charge on my credit card, but was forced to remit the amount to the 3rd party payment service. I mailed a final demand letter to the seller via certified mail, and I have proof that she signed for and received the letter. I would like to know what steps or legal action I should take in order to receive my refund and possibly punitive damages for fraud. Thanks.

How much money are you out? If it's within the small claims limit for Ohio, go ahead and file a small claims action in Ohio. You won't be able to get punitive damages, but you should be able to get your money back.

You could also contact law enforcement in her town, let them know what's up -- that's unlikely to get your money back, though.
