Contract question here...I signed a lease contract with PC Direct Biz.com for the purchase of a computer system. I paid them a $99 non-refundable deposit, which was clearly stated on their website and in the contract which I signed. It has been 5 months, I have not received my computer. Now, they are not deducting money out of my account, or billing me for anything. Also, the contract states I may terminate at any time prior to merchandise being shipped. Lastly, the website & contract both state allow usual 4-6 weeks for shipping. When I've called them, my answer has always been "we have an unusually high number of orders to process." I smell bull**** and scam.
So, my question is this: Do I have any legal means to obtain my $99 back? Or, because I signed the contract & it states non-refundable, am I s.o.l.? No, I am not looking to sue for $99, just wondering if there is some sort of law I can quote them in a letter that states "they are not fullfilling the contract on their behalf in good faith etc, etc." Bottom line, I will not cry over losing the $99, but if I can get it back w/ minimal effort, I'd like to do so. If it matters, their offices are in Atlanta, GA.
