I am in desperate need of help. I signed up over the phone to get food delivered to me everday for 30 days. I paid with a credit card. The containers that the food comes in are microwavable and it states it on their website. After 10 days into my program, I heated up my breakfast and after 2 mins my whole house smelled like smoke. I opened to microwave only to find my food burned to a crisp and the container melted on the botton into my microwave. I called them up to cancel and demanded my money back because this was not supposed to happen. They cancelled and refunded my money for the remaining days I didn't receive my food.

Now I want all my money back because this was a faulty container on their part and they won't return my calls or emails. So I told them I will go to small claims. and they responded that we will be ready for any legal action.

I still have the container and after 2 weeks, it still smells like burnt plastic.

I have never filed a lawsuit or small claims and I don't know anything about it. Do I have a case?? Should I go forward with small claims? Will I get my full refund for my money?

Greatly appreciated! What is the name of your state?

They gave you a refund for the unused portion of the service and NOW you want more money?? Should have asked for what you wanted up front.
