I recently sold a large sum of merchandise over EBay. I insured the package but neglected to get an online tracking number. The buyer claimed to have never gotten the package and before consulting me, filed a claim with Paypal. After checking with the postoffice I found out that the package was being held at the buyer's post office and that she had recieved a notice in her mailbox stating this. I informed PayPal and the buyer of this and provided them with the Insurance number (which can also be tracked but you have to call the postoffice). PayPal froze my account and refunded the buyer. I called the buyer's postoffice to have the package returned to me only to find out that it had been picked up at 10:51 AM this very morning. Can I file a small claims suit against this individual if they do not return the merchadise or reimburse me for the money? :mad:

This is what happens when you deal across State lines, and with people you haven't met. When you deal with the Internet, you must accept getting scammed. Hope this teaches you a lesson.

Hi from New York,

Because you did not purchase Delivery Confirmation for Tracking, the fault is yours.

You were not able to provide a Tracking Number so the buyer is in the right in this case.

Sorry.

Lesson: Always purchase Delivery Confirmation for .45 Cents when shipping an item within the U.S.

If you can get the Tracking Number from the Post Office, you may have a chance of appealing your case to Paypal.

know a way for you to get your money back

this sounds kind of bad, but since she/he scammed you. you can do it to them to get your rightfully owed money back. Send a package with something in it of no value to you, slap his/her name on it and get delivery confirmation from the post office. Send paypal the number via email and voila! you will get your money back. You should have used this tactic as soon as she/he filed with paypal. I say scam the scammers. I do it all the time on ebay if im scammed.

You are one of the reasons that I will not shop on e-bay any more. I paid for an item recently and never received it. I waited for 30 days after I paid for my auction and e-mailed the seller asking if there was some sort of hold up. She did not respond and 4 days later I e-mailed again. This time she responded with "Oh, I am sorry, but I am so busy with 3 kids and it has been very hectic around here". (Yeah, I know busy as I have 6 children) She stated she would mail it out that day, which was 42 days after the auction had ended. 2 weeks later and still nothing. Now she claims she mailed it but "mysteriously" the receipt has vanished proving this. I opened a dispute with e-bay, who will do hardly anything because the item was not over $25. Now she also says that I am lying and received the auction but also want my money back. I have 100% feedback and have never had an issue like this. I have received every item I have purchased with the exception of this one. Why would I lie now? I'm not ~ I WAS SCAMMED. I hope you see "mygirllexy6" that your way of handeling the situation is wrong. Sometimes the buyer gets scammed too!

Okay?? That would only proved that you shipped the item out later than you had originally promised.....so they'll know that's not the original package. Besides the OP had the insurance # I believe so that should prove the buyer picked up the item anyway. Correct me if I'm wrong.
