Hello,

Here is my situation and I am not familiar with the proper name and/or the category this would go under, so I did my best.

I found a craigslist ad about a car engine and transmission that someone was selling. I contacted them and settled for a sum of 240. The add stated that the engine had to be pulled by the buyer (myself) as it was in a motorhome. I agreed, and told the seller that I was bringing a cherry picker (engine hoist). I arrived there on a Friday, met the seller, and he introduced me to a kid who lived around the area who was going to help me pull the engine. I immediately told the seller that it would be impossible to take the engine out without making a huge hole in the motorhome and he said that I could make the whole to attempt to take the engine out. The seller left and me and the kid got to working. The problem was that the motorhome did not have a hood and the engine was impossible to take out without having some sort of caterpillar construction truck to lift the motorhome up and drop the engine. The owner left for an event and was not there for the four hours me and the kid spent trying to take it out. The kid and I equally participated in making this hole. The motorhome was broken since it had a broken axle which is why he was selling the engine and then junking the motor home. After those four hours, we determined that it was impossible to take this engine out with the tools we had. I called the seller (as he was out of town by then) told him the situation, he said that he was not about giving money back after shaking on it (which we never did), and I told him that if he could get the engine out I would take the engine instead of wanting my money back. The seller told me he would get in late that same Friday, so on Saturday he would look at it and have some other people take a look to see if it was "pullable". On that Saturday at noon he stated that he would give me my money back, but just 200 of the 240 because he had spent 40 of the 200 and somehow could not fully give me my money back. So on Sunday I headed up (about 2 hours drive) to collect that partial money, and the 40 that was missing he was going to mail. About 30 minutes into the drive I get a phone call from him stating that some guy called him saying that he wanted the transmission and was willing to pull the engine out. So the seller asked if I was still interested, in which I replied "no". I though about it for a bit, and 5 minutes later I told him since I wasn't getting the transmission, if he would knock the engine down to 180 and just give me 60 (from the 240) that I would still be interested and wait for this person to pull the engine/tranny. He stated that this person said that he knew what he was getting into and knew how to pull these engines from these motorhomes. He told me that this guy would come on next Sunday and pull the engine. So I went to his home, picked up 60 dollars from my 240. The seller was not there, just the kid that helped me pull the engine. I got my 60 and went back home. About mid-week (Wednesday) I searched the same keyword (engine type/model) on craigslist and found that he re-posted the ad for the engine, with similar description, but knocked 50 off the asking price. I became suspicious, so I printed this ad out (I also have the original one I responded to) and decided to email him about this new ad and told him to tell me when the engine was pulled so I could come to collect it. I did not give a name because I wanted to see if he accidentally re-posted and would tell me that it was sold (since we agreed and he kept the money). I emailed him with the same email address that I had used to respond tp the previous ad. He did not recognize me and asked who I was. I told him I had payed for the engine and my name. He responded with a "I'll let you know". Three weeks passed, with me checking every Sunday, and excuse after excuse was made about the guy coming to get the tranny. So I decided to ask him for my money back, to which he responded that he was in vacation and would send the money when he had the chance. A week passed, I left for vacation for another two weeks after that week passed (total of 3 weeks waiting for money), came back from the vacation and no money. I contacted him via text (and still have these texts) and asked why he had not sent the money. He stated that I had destroyed his property and that if I demanded for te money back he would sue me. I told him that I had EVERY single official email, and the two ads (the one I responded to and the re-sale one after he had my money in his possession).

Now, I am a college student and I am in the process of rebuilding a muscle car, which is why I wanted the engine, and even though 180 is not much, it is to me. Here is what I can come up with:
1) Stealing my money
2) Framing me for destroying his property***This is very important...I have two emails from him saying that he wanted to junk the motorhome once the engine was gone. He also gave me verbal permission.
3) Re-selling the item even though he had my money in his possession and we had verbally agreed on it.

What would this case be considered? I would like to represent myself, so what is the name of the court tyoe that I would need to search for?

How valid is my case?

I have the two ads, about 10 emails, and I think I can get some text messages that had been erased (memory filled up and erased) from my provider.

I am very sorry this sounds complicated and is long. Please help me and I apologize if this is in the wrong section, just not familiar with law terms and labels.
