What is the name of your state (only U.S. law)? NC

I purchased products last April from an online store. Got the confirmation and the products came no problem. 10 mos later I get an e-mail saying I have a past due bill. I had not ordered since. I was puzzled. I contacted them and they said that the payment was approved by cc company but the glitch in their shopping cart - or something they don't know but the money never was deposited into their account.

Now they are demanding payment immediately. I was upset that it took them 10 mos to send us a notice of the issue.

What are the legal rights on online purchases?

It isn't a matter of want to or not wanting to hear an particular answer it is wanting to know the law.

Marty,

We can search until the cows come home or until the sky falls, but we will not be able to find you a statute saying that it is okay for you not to pay for a product because of an error.

So, do whatever you feel like doing but don't complain when you get sent to collections. Don't be surprised when your credit score takes a dump.

Zigner, it's because it is not what the OP wants to hear. OP wants to hear that of course, he doesn't have to pay for the product he received, that the company has waited too long. :rolleyes:

OP, why do you have a problem paying for items that you have received but not been billed for?

It is nice that you can read my mind and know what I'm thinking or wanting to hear.

It isn't about me wanting to not pay for them. I want to know the LAW! Simple! I didn't ask for judgment or moral comments. Just the law.

I don't even need to justify my question to anyone.. I did offer to pay just for your need to know! How rude and immature and is this forum moderated?

I didn't ask any one to look up a law to justify my need to not pay I simply ask the law! How complicated is it! Are you a lawyer and you speak to people this way. Glad your not my attorney!

I had an issue years ago similar and the law was different. Goodness! Can't even ask a question here without getting treated like your some idiot!

I have enough intelligence to figure out the vast information you have given me!

YOU ARE LEGALLY REQUIRED TO PAY FOR IT! I'm not sure why you are acting so dense about this. And, the law hasn't changed on this in many, many, many years.

Was there any money taken out of your account when you purchased the items?

Was there any agreement that the item was sent to you under the expectations that you pay at a later date?

Hands down they should not have sent you the item without first getting your payment finalized. If it had been an error in their favor they would make you jump through hoops to correct a mistake. They had a glitch in their shopping cart and in my opinion they sent you an item that they considered paid for.

My advice is to ask them to provide proof that you even purchased these items and if they cannot prove your bought it then there was no purchase.

Ridiculously idiotic advice since the OP acknowledges buying and receiving the product
