I purchased some automotive items online for a motor that I am building.

The sellers "refund policy" states items have to be returned within 30 days.

I didn't even get the motor started for 4 months after the purchase. I cannot build a motor in 30 days.

Two of the items were found to be defective immediately upon starting the motor. They were professionally installed by certified mechanics.

I asked the seller if he would stand behind the items and he said to read his policy (which states 30 days).

I sent the defective items back and they are in his possession.

Currently he has my money and the defective products and will not return either.

The seller resides in Texas.

I would DEMAND that he return your property. Offer to pay for the shipping and any storage costs that he may have incurred for storing your stuff.
You knew the refund policy when you decided to purchase the items. If you didn't like the terms, you should have shopped elsewhere.

Unfortunately, you agreed to a 30 day return period when you purchased the parts. It's really not the sellers problem that you bought parts and sat on them for four months. Sending them back was a mistake, as you no longer can try to return them to the manufacturer.

So....it doesn't matter that the products were defective.
It just matters that HE says 30 days.
He told me to return the products for him to look at, so I did.
He has my money and my products that I paid for and I'm just out of luck?

Shouldn't I be able to force him to return one of them....either the money or the products?

His "return policy" doesn't say squat about keeping my products if he's not going to refund/replace them.

30 days is 30 days. You knew that upon buying. You should have inspected the parts upon receiving. You waited until you built the motor to see if everything worked. You're out of luck.

As for him having the parts, I'm not buying that he told you to go ahead and send it all back. That would be to pertinent to leave out of your original post. You mailed him the parts voluntarily. Why should he be out the cost of re-shipping? You shipped him the parts, you can send him the money to ship them back. If he refuses to send them back upon receipt of your money, then you've got something to go on here.
