What is the name of your state? WA

I purchased an item online back in Dec. 07. This company charged my credit card the day after I ordered the item. They did not respond to any emails and did not have a phone number to call. Over a month later I had not received the item so I emailed them that I wanted to cancel my order. Magically they responded the next day stating that my order would be shipped soon. I told them I did not want the order now and to cancel my order since I had found the item else where! The company went ahead and shipped the item over a week after I canceled my order. I returned it and asked for a credit but they will not give me a full credit because they want to deduct shipping. I stated that was not acceptable because I had canceled my order prior to them shipping. I stated that I would dispute this with my credit card company but now the company want to charge me $75 for a chargeback fee. I have emailed them numerous times which they "claim" they have troubles receiving emails from AOL, MSN, Yahoo or Netscape. I did manage to get a phone number but they only have an answering machine. They did call once which I missed but yesterday I called four times and left messages and they are not returning my call. Once again they emailed me last night telling me they would only credit my account minus shipping or give me a coupon to buy another item from them. Huh? I believe they are taking advantage of me. I will not back down. Do they have the right to charge me $75 for a chargeback when they are obviously at fault? What legal recourses do I have?Since they are making it impossible to contact them I am at their mercy.

Yes they do have a section in their Terms about chargebacks and I have investigated disputing the charge with my CC company. I have not disputed this with my credit card yet because the online company is threatening me with the $75 fee. Can I dispute this without the chargeback threat?
