Hi, I live in California and recently made a purchase from someone online for an item. I paid via PayPal and the seller lives in Michigan. This was an auction item that didn't sell and I found it through Google and made an offer to the seller. Anyway, after making the payment, the seller promised to mail out the next day. After 5 days went by I emailed to find out how it was shipped so I could leave the appropriate note on the door thing for the delivery people. Anyway, he emailed back and said he didn't mail it out yet and his dad was in a terrible car wreck and would mail it out sometime soon. Every bit of info I have received from this person I had to email for, including missed shipment, etc. They never even let me know it wasn't shipped the times when it was supposed to be.

Anyway, to make an all ready long story short, after a while I emailed and asked that we just cancel the deal as the time has rolled past for this transaction. The email was read but I didn't receive a reply this time. If PayPal fails to remedy the situation for me, do I have any legal recourse to get my money back at least? Where would I file a small claims action? Of course I'm not jetting to Lansing.
