Having discovered VOC's in our well water two years ago and then having purchased a water purification system with a 10 year warranty on all parts and media except the R.O. membrane that has a 5 year warranty, we are now having difficulty compelling the selling company to honor the warranty on the parts and the media of this now non-operational unit. The unit cost was in excess of $4500. The company is still doing business. The failure of the system and the absence of response on the warranty over the past several months, as well as concern over ingesting VOC's in excess of the OSHA safe limit has caused us to sign up to be tapped into village (city) water at close to the same cost as the purification system.
Does one sue an out of state seller in the seller's state? The buyer's state? Is this appropriate for small claims court? Can we ask to be compensated for the cost of tapping into city water? Is it appropriate to ask for the unit to be repaired, shipping included, at the seller's expense; or, is it appropriate to ask for a pro-rated refund of the purchase price?
Is this worth the effort? We're not poor, but a total of $9000 is a very healthy amount of money to us. Thanks for any insight!
