What is the name of your state (only U.S. law)? I am in the UK, but it's a question regarding an on line purchase of software and I assume any law for online purchases is worldwide (I hope).

I purchased some software which didn't do what it said on the tin and kept crashing the browser it stated it was made for. No problem i thought, the developer was offering a 'No quibble FULL refund'. I asked for the refund and the developer stated that he was only going to give me part of the money back, as that was the part he 'had', the rest was VAT and I had to go to the processing(at first he called them a reseller- now he states they are the processor)and I was told to contact them for the VAT part of the money

It was the developer who made claims on his website that he was happy to give a full refund not the processing/reseller company.

1. I need to know where I stand legally. It is the name of the reseller/processing company who I made payment to via paypal, where do I stand making that claim against them via pay pal and how would pay pal view a claim if its just a processing/reseller company?

2. If the developer stated 'full refund' surely he is liable to give me back the money and not make me chase VAT costs from the processing/reseller company?

Or can anyone make wild claims of full refunds to make customers feel safe in purchasing from them online?

3. Is there an official body I can complain to about his company and its sales practice?

I hope I have more than one leg to stand on because he is being most unhelpful and certainly hasn't made any attempt to even pay back part of the money in the few days I have been asking for it. I hope that there is some protection for customers purchasing online. It's a scary thought that there are people like this out there who know customers are left with no optiont han to be conned.

I hope you can help, it doesn't look like I will get my money back.

Unfortunately, you standing on the wrong side of the Atlantic Ocean.

I have no idea what UK laws may protect you, which is why this site states US Law Only.

If you come to Massachusetts, you can file a claim under the Massachusetts Consumer Protection laws, generally referred to as 93A.
