I am a ticket broker in CA and I am being threatened a lawsuit by a ticket broker in NY. I sold tickets to this business for a concert in NY. I sold 8 tickets to him at 450 each. He then resold them at a higher amount (assuming). I purchased the tickets I sold him from another party who is now long gone. When his clients went to the concert they were told that the tickets were invalid and they would not allow them entry. The day after the incident, the owner called me very angry; and requested a refund. I sent the check out that day and it was deposited a couple days later. This was at the end of May, 2005.
Yesterday I recieved a letter from his lawyer. It says "By selling my client counterfeit tickets, you have breached both purchase and sale agreements, in violation of CT law." he goes on to say that his client has tired to reslove the dispute but I have not cooperated; and that he will take legal action against me seeking compensatory, consequential, and punitive damges for breach of contract, fraudulent inducement, and multiple violations of CT's unfair trade practices act.
What kind of case does the broker have against me? Once I gave the broker a refund, I never heard from them except for them to make new purchases with my business for other shows. Now his lawyer is making up stories that they have tried to contact me. If they do have a case against me, what kind of out of court settlement should be reached?
