What is the name of your state? new york......I am asking this for my daughter who lives in new york. She just went through surgury a couple of weeks ago for cancer. The cancer so far is gone. She has been getting quite sick from the treatments even though after 4 days she went back to work. She was afraid of losing her job. (she is 20), and has her apt, and bills she has to pay. she is still not feeling well, and since she has only worked for 2 months at her new job, she is afraid of calling in when she is sick. Is there any protection for her due to this illness? If her job does let her go due to her time off (which I realize is an at will company) is there any other resources for her? Thanks so much Faith

I'm so sorry to hear of your daughter's illness.

Unfortunately, since she has only worked there two months, she is not eligible for any protected medical leave under either state or Federal law. So yes, she CAN legally be fired for missing work.

That does not mean, however, that she WILL be fired. What does her employer say?

I'm not familiar with the resources that may be available in her state; however, she can certainly check with the state and also the county about what aid may be available to her.

thanks for responding CBG, been a rough year. I also had another scare this morning with my son getting into a car accident. He is ok, other than a broken wrist and bruises and cuts on his face. The Lord has been protective in so many ways with my family. It could of been so much worse. An Elderly lady hit him from behind while he was at a stop sign. My nerves are pretty frazzled. In regards to my daughters condition, she needs more tests and more therapy. She is doing ok other than being tired and her lymphnodes are bothering her. Her employer has not given her any warnings yet, but I am so worried about this whole outcome. As you know I went through this over a year ago, my son had testicular cancer, he is doing great, other than his accident this morning. This makes my own issues so obsolete. But my stress level and emotional strength is so drained. Sometimes our problems in life no matter how bad it all seems at the time can never compare to the many other what if's, and other life struggling issues so many have to endure. Fight for what you believe in, never give in, and care about your neighbors and their needs, because when it's your turn, the support of others will be your strength and will follow you.
