I bought a car from a used car lot. I have to admit that I didnt go over the car as I should have. I could use lots of excuses, Im 44 and know better and in fact went with a check list I printed off the web but didnt use it ... dumb dumb dumb.

Carfax said that the car was it and sold at auction twice. No big this, thsi car was meant to be my clunker anyway .. but, went I signed on the solid line, I did not know the extent of rust on the underbody of the car. The saleman kept saying that the only mechanical problem was a front strut and the rear windows not going down. He also said he just did the brakes himself.

The undercarriage is a crusty flaky rust mess. I pulled the rear tires to find the brake drums rotted through on the face where the tire and wheel are bolted on. The shocks are just about rotted through. All the low lying coolant / a/c tubes are crusty / flakey mess.

Do I have any legal recourse ?

For sure I will be contacting every single private and public office and web page to shed light on what this guy is selling.

I'd say caveat emptor, except that the dealer specifically represented the car in a better light.

My ex owned a car lot and he and his business partner told me that as-is is voided if a dealer intentionally misrepresents a car. If the dealer were to say that he believed the car is mechanically sound and free of problems aside from this and that and it ends up not being so, well, he knowingly lied.

However, the problem will be proving this. I highly doubt the bill of sale says the car is perfect and free from rust. So unless the dealer will testify against himself, you're out of luck on his one.

LOL, ironically, the least honest person I ever met was that ex of mine. Though he was honest when it came to cars, he wasn't honest with anything else, from the reason he wanted to marry me to the other women he started dating a few weeks after we met! He also stole my company from me after destroying all docs that could have proven it. By the time I knew what he did, it was two years into the company. Lesson learned.

Based on your description, it sounds like the car sat in salt water for a while. Was it ever registered in LA? Hurricane car maybe?

Anyway there is more then one way to skin a cat.

I am in the information systems field and am well versed with the internet and its use.

So using my career experience, I have launched an all out attack, extremely severe I might add, on his business. I have gathered email addresses found on the web for neighboring counties reaching out 200 miles in every direction. In addition I have located and stored used car sites that he has posted on and given reviews where possible. Any free ad sites I found, now also contains a post advising that everyone should stay away from his dealership in addition to listing all of his posts titles inside that warning message. This way, anyone searching for a 1971 Mustang Fastback. Will not only hit on his post but is sure to see mine too. I also have a friend who runs a small web hosting company who agreed to create a internet domain for me so that I can post pics of the cars undercarriage and tell my story. When the search for ...

.. and you know .. I already got two thank yous. A loss of two potential clients in about a 18 hour period. Thats not a bad rate of return. See there is some justice in the world. Because of automation, I will only stop my script until every dollar I spent is paid back ten fold in loss of potential customers.

Another nice development is my godchild just graduated today with a Psych major and pre law minor. Smart kid. She wants to work with the Police department. She gave me some good pointers on how to find this guy if he changes business names or moved the business. Ill stop short of saying, public records.

Aaaaahhhhh .. the internet is such a nice tool.

I'm an insurance agent. I'm just trying to figure out, based on the fact that you don't have a legal recourse, what getting the name(s) of the previous owners will do for you. However, you might want to remove the person's business information in your post. Based on your usage, you are violating the terms of this site.
