In Texas:

I have had several job interviews bout I have not received any job offers. I’m beginning to think that my references are not good. Would it be worth my time and trouble to hire a reference checking service? Some companies will, for a small fee, check the references that you would place on a job application. That company would then give you a summary of what your references supposedly really think of you and your work history.

Also, negative references are not, repeat, NOT illegal, contrary to what a frightening number of people believe. The employer may provide any information that is true, that they have a valid and supportable belief is true, or represents their honest opinion. If I recall correctly, Matthew, you were fired for a reason you have come to realize was valid, even if you still believe it to have been excessive. The employer is within their rights to give that reason to prospective employers. The prospective employers are within their rights to take it into consideration when making hiring decisions.

It is not necessary for you to agree with the reason for it to be expressed. The ONLY way it would be illegal would be if the information expressed was FALSE. Example: Matthew was fired for unprofessional behavior, is true; therefore, you have no legal recourse regardless of the consequences to your employment. Matthew was fired for stealing, is false; therefore you would have legal recourse if you lost employment due to this reference.

Just something for you to keep in mind when making your decision.
