My husband and I are currently seperated. I had to get an order of protection against him because he was threatening suicide and threatening harm to me. The order of protection was served 10/29. On the OP, I was granted full and exclusive use and possession of the apartment, meaning he could not return to the premises for his belongings unless a police officer was with him, and he had to hand over the apartment key.

My question is- how long by law am I required to hang on to his belongings? I was told 30 days by a co-worker... I'm not crazy about having all his crap sitting around that long. And I have no idea where he is now, and I highly doubt he will be returning for any of it.

Any insight would be appreciated!

No hearing. in AZ there ususally isnt from what i was told, unless the person it is served to requests one.
Hmmm. ok.

Your best bet then, is to draft a letter detailing exactly what is in the house that belongs to him, and give him a set time frame which to contact a 3rd party that you designate in order to make arrangements to pick his stuff up.

Or, move his belongings into a storage facility. Pay the first month's rent and then send him the key/code/location.

I presume you'll be filing for divorce?
