okay screwed, i have got to ask a question. and everyone needs an honest answer. when you told mon that you were uncomfortable with her attire, what exactly did you say, and what was mom's exact response?
Okay, here is how the conversation went

Mom - You're 20 minutes late you were supposed to be here at 3:00 pm
Me - Sorry, traffic was really bad on the 90/94

Mom - You're so disrespectful, you stroll in here 20 minutes late with a smile on your face, Ellis has a schedule to keep, the only reason you are here is because I choose to let you see Ellis you prick.
Me - Well nice to see you at least have some clothes on today, walking around last week end half naked without underwear, were you trying to seduce me, do you really think I would fall for that?

Mom - you're sick, I'd rather be mounted by wild dingos.

Mom - you need to leave
Me - I drove all the way out here to see my son, I'm not leaving.

Mom - I'm calling the Police.
Me - I'm out of here.

Yeah, here's the deal. When you don't have a court order to see the child, it's at mom's whim. So being an ******* to her in her house is a bad idea. And you were definitely being an *******.

And then you REFUSE TO LEAVE until she threatens to call the cops? For real?

The hearing isn't going to go well for you.

File for visitation and plan for a graduated schedule, public pick-up/drop-off and the restraining order to remain in effect wrt Mom.

Well, I guess I just don't know any better. Is there a chance that I can get visitation in my own home? My son is less than three months old, I had assumed that the courts would not allow him to be taken from his mother at such an early age. There is no way she would agree to visitation in my house or in some other public place.

you two are both stupid. if mom were here, i'd say the same thing to her. now i understand the restraining order. maybe another senior can help you with the restraining order, but i'm lost on that. like suggested, do not contact mom under any circumstances. file for a set visitation, unsupervised. you do not have to have visitation in mom's house.

If you FILE IN COURT for visitation, Mom doesn't HAVE to agree. The COURT will decide. And yes, you can get a schedule that will allow you to have time w/the child - probably not overnights right away, but working up to that. You don't have overnights NOW though, so you'll be working towards more time than you currently have.

Look up the Indiana parenting time guidelines. They offer a graduated plan for infants.

The judge ordered supervised visitation at a Non denominational church in her neighborhood, two, two hour stints per week. I'm thinking about bringing a video camera at every visitation exchange in order to prevent any other false accusations. She did not have a police report substantiating the sexual assault allegation.

Bring a video camera is foolish and will just irritate the judge. You don't need one anyway because the supervisor will be there and can testify to any bad behavior from either of you.

And many supervised visitation centers do NOT allow camera or video cameras due to the fact that there are various reasons why supervision is necessary. For example a parent is ACCUSED of sexually molesting the child. Imagine what video or pictures would do for a parent who actually had done that and had supervised visits.

Bringing such stuff is a perfect way to get supervised visits discontinued.
