I was divorced from my x-husband in 2003. I have remarried and had another child and life is good. I have 2 children from my x-husband. We have always been friends, and he has been struggling with jobs etc. The Attorney General filed on him for owing me almost 5k in back support. I did not agree with this amount and told my case worker I didnt. Due to the letters and threats, out of the blue, my x got a lawyer and filed an order to trasnfer jurisdiction, and an order to modify parent child relationship. He "says" it is just about the money, and he cant afford to pay me the amount they are saying. But if it was just about the money and he is struggling, why wouldnt he file an appeal with the Attorney General instead of spending money on a lawyer? Now he has a current order for Medical Insurance, which he lost his insurance in Dec 2008, and I have insurance on them paying $96 per month. He owes me 1900.00 for this year in back pay when he was laid off, and he stopped paying me 30 days before he filed the law suit. This is the 3rd year in a row I have not had child support at Christmas, last year he stiffed me 1600.00 in tuition for our daughter on Christmas Eve. Is it legal for him not to pay me since October 28th when the papers were filed Nov 24th? I filed (off the internet) a general denial for both forms. What is my next step? He has no chance in custody, but what is the chance he is lieing and really going after custody? If he is only bringing home 1800.00 per month and I pay 96.00 monthly for insurance, with him having another child 22.5% is 405.00 per month + insurance premiums if I understand correctly, which would be more than he pays me now. He was working a very high pay job, but we agreed on 226.00 every other week when we got divorced. I felt this to be fare as well as him. I am tired of expecting money I do not get, and then having him ruin my Christmas to sue me.. I dont think I am being unfair, but I dont trust him anymore.What is the name of your state (only U.S. law)?
