I realize that this subject will solicit a variety of responses, both moral and spiritual, I don't want advise on how to live my life. My question is academic. The government has seen fit to prohibit me from selling, for example, a kidney, with the threat of 5 years in prison and/or a $50,000.00 fine. If an individual were to offer the same organ for an exchange of goods or services, can this penalty still be enforced? And if it can, is there a legal arguement that can be made to defend against the charges?
