I will try to make a long story short....I have an account with AMEX. They stopped sending me my statements about 2 years ago. I wrote them letters (I believe about a dozen in all) telling them that I was not receiving my statements and I never received a single response from them. The last few letters I sent basically said send me my stuff or I'm not paying you anymore because I had not idea what my balance was, what charges they were adding, how/when my pmts were being posted, etc. I also tried getting the info from their website but was unable to access it. I made my last pmt to them in July, 2001. I never heard from them again until I was contacted last fall by a CA. I sent them a verification letter since all I really wanted was info in the first place. I never received a response. Earlier this year I was contacted by a different CA. I again sent them a verification letter and received no further response. Now today I get a message from AMEX themselves saying that they are have 'pulled' my account from collections and that the I need to make pmt arrangements with them immediately.

1. What do they mean when they say they 'pulled' the account from the collection agency? Does this mean that it was just assigned and not sold?

2. Do I still have the right to request verification even though it's the original creditor? I still have never received any of the info I previously requested either from them or from the CA's.

3. Do I have the right to send a cease and desist and request that all communication be in writing, or do they have the right to continue to contact me by phone since they are the original creditor? This have gone on forever and I have gotten nowhere. I don't trust anything I can't see on paper.

Any help would be greatly appreciated!

Yep, that would be what it means. AMEX doesn't seem to SELL accounts very often.

You have the right to request a full accounting of what they say you owe them. Were I you, I'd put that request in writing and attach every single copy of all your previous requests (if you have them) and emphasize that you have TRIED to get info to pay them on numerous occasions. This time, send your letter certified, RRR so you KNOW they got it and they cannot deny receiving it.

You can send a C&D, but since they are the original creditor and NOT bound by the FDCPA, they don't have to comply.
 
Thanks for the info. At least I have a place to start. I did indeed keep copies of the dates that I sent the letters as well as the letters I sent the CA's, wich were sent CRRR. I will start with that.
