What is the name of your state? I live in FL now, the dispute is in IL.
I lived in IL and I went to an Orthodontist there to get braces. Signed the contract for 2400 in May of 04. Kept paying and going for visits until March 05 then I was moving to FL. I had 1490 left. Now the orthodontist wants me to pay off the whole amount ! That is ridiculous since my treatment wasn't finished. He doesn't want to prorate that amount at all. He wants every penny. Is he crazy!
Now he was blackmailing me too...money or no dental records for like 6 months. So I finally got my records from him so I could finish my treatment here in FL. My new ortho quoted me 1500 to finish my treatment.
Now I received one letter from IL stating that I owe 1490! He didn't finish the job so why am I obligated to pay him. SO what are my rights? How can I resolve this matter???
Should I get a lawyer involved? Plz help

Ortho dispute

Yes I did sign the contract for the amount of 2400 but that amount is supposed to include retainers which I never received, treatment visits for the next 1 year. My teeth were not straight when I left in March. He even wanted to take off my braces when I told him I was moving at the next visit. Why?? So he could collect the money. Even my orthodontist now said that the job was OBVIOUSLY not finished.

Are you saying that its your orthodontist's fault that you moved? I bet that he is willing to finish his part of the agreement. Of course your teeth aren't straightened out yet, they're not supposed to be straight yet. It occurs in stages. You are required to complete your part of the contract.

I'm guessing that you will be receiving collections notices in the mail soon.....

What does the contract you signed say about not having to pay if you move out of state?

It's not his fault that I moved but is it mine? He wanted to take my braces off at the next visit! So if my treatment was finished why do I still have them on?
So I should pay him that amount? Why if he is not doing the job.
What about the retainers? ANd the visits for 1 yr ...is that FREE??? Makes no sense to me.
So I can't file a complaint or anything? Law isn't on my side?

The contract that I signed doesn't go into details like that. It just shows the amount and that I agree to pay that for the treatment. I don't see any details in it.
I asked my ortho about this matter and he stated that an ortho ..if a patient moves will prorate the amount owed..thats what happens if a patient moves.

Disagree with previous response. Moving away from the area makes your performance of the contract impossible, or "impracticable", to use the legal term. The contract is void. The old ortho should refund the difference.
