What is the name of your state (only U.S. law)? TX

Not sure if this is a support issue or not, but here goes. I am CP and my 13 year old daughter has a minor crossbite. Teeth themselves are straight but her bite is slightly off (so is mine for that matter, but it was never corrected. I've survived.). For reasons I don't understand, my ex wants this fixed now. Problem is--his dental insurance changed last spring, and the new company has a one year waiting period before it kicks in. That would be April. I was the one who checked into the insurance told ex that there would be no coverage if we started orthodontic treatment before April 09. He is now insisting that treatment can't wait and that I am negligent is I don't get her to the orthodontist next week. I've told him that I will take her if he wants to reimburse me for the amount of insurance benefit I would lose.

Is my stance ok legally? I just don't see any reason to throw this benefit away, since my daughter is not suffering.
