I have been directed to go to a collections agency to try to get back my money that a man borrowed from me in the amount of 2000$


I gave them phone numbers to places he may be and people he knows, and last known addresses. I have been unable to get my money back from this person myself.


What I would like to know is what does the collections agency do? What would they do differently then me to collect my money and how does putting a claim thru effect the debtor.??

Any info would be greatly appreciated. Thank you :)

In most states, a debt collector can't do anything to assure collecting your debt. All they can do is contact (harass) the debtor until either he pays, or he tells them to cease all contact per the FDCPA. Then, the debt collector must STOP all efforts to collect.

Now, if you really want to collect AND if your debt is provable, take the debtor to court and get a judgment. Then, with the judgment, you can use the laws to enforce it. Also, the judgment has a MUCH longer statute of limitations.

If all I can do is harrass this guy with a collections agency at least its something. I do not live in the same state as he and I am disabled and cannot travel to his state to sue him. This is why my question was concerning what collections do not what should I do overall. I have already been told it would cost too much for court when the amount is only 2000$. Someone already gave me that answer.

My question is what does collections agencys DO and what actions do the take twards the debtor

Most states will allow you to file suit on a person out of state if the debt was incurred in the state you are in. If you loaned him the money in your state, you should be able to take him to small claims court and get judgement. Chances are he won't even show up.

Unfortunatly the state HE lives in is California. The state I lived in was Nevada when he borrowed the money from me and NOW I live in washington I am unable to travel due to being very ill. So I cannot go to california or nevada.

I still am not sure wich route to go tho. If I do succeed at a collections taking my case so to say I will be happy enough to harrass him.

I shouldnt have lent him the money anyway but I did have him signed contract. Unfortunatly I guess cant go the court route becuase Im ill and cant travel to his state. Or I sure as hell would :)
