I am in the process of making a claim against an individual who lives in West Virginia and I live in Maryland. I paid for an item and he never delivered the item or refunded my money. My question is: If I win the claim, can I be compensated for the travel expenses, hotel, and time required to attend the court case in the other state? It is ~ 350 miles and 6-7 hour drive. Can I also be compensated for court costs, filing fees...?

Most Small Claim courts do not allow for recovery of extra costs (travel, time, etc.) since those are not damage and are part of your consideration in bringing the suit.

However, if you win a judgment, it will include reimbursement for your direct costs, including fees
