Out of State dispute with a Hotel

I live in Illinois and cancelled a Hotel Reservation for a stay in New York City in November. I cancelled my reservation within the Hotel's stated policy, but did not get a cancellation number. I did document the time and the person I spoke to, however.

When I received my American Express statement, I discovered that I'd been billed as a "no show". I then called back and spoke to the Hotel's Front Desk Manager. He indicated that though the Hotel had changed its cancellation policy recently, he would credit my account, since the original policy was in effect at the time of reservation. Again, I did not get a cancellation number, but did document the date and time of this manager.

The credit never came through, and I have submitted two claims to American Express. They haven't been able to help. I plan on calling the hotel direct before taking any further action, but I am curious about any legal recourse I have. The amount in dispute is $364.07.

This time when you call them, ask them to confirm your credit to you by FAX or mail. Also, get all the information including a confirmation number. Oh, and keep your notes.

In my opinion, it would be totally impractible for you to even consider taking any legal action against them. After all, they certainly weren't negligent or malicious.
