What is the name of your state? live/work in MA Company headquarted in CA.

My wife's company was sold to a company based in ca. She works from her home in MA. This is a full time postion. Because of this we have been forced to take the company PPO plan instead of the HMO option. This means that all of our medical bills are out of network. Which means we have higher out of pocket expenses than if we lived in ca. and could use the HMO plan and have everthing covered, with little or no out of pocket. Short of finding another job is there anything we can do? Is it legal to have a two tier benefit system?

Is it legal to have a two tier benefit system? Yes, and it's quite common. No laws require an employer to offer identical benefits to all employees. It is often particularly difficult to do so when employees are in geographically diverse locations.
