Over Time Pay...Can He Do This???

I am writing for my fiance' who just called me from work quite upset and ready to quit. I could really use some help on this, since I'm not sure if this is legal or not.

My fiance and I live in Michigan, and he works for a landscaping company that also does snow removal through out the winter. He has been with this company now for just over 2 years and makes $10.00 an hour.

Today he said that his boss approached him and told him that he is working too much over time and that he cannot afford to keep paying him over time. (His over time rate at time and a half is $15.00 and hour.)

The boss told my fiance' that for now on, any over time that he works, will be paid at his hourly rate of $10.00 an hour and not $15.00 an hour.

I must also say, that the over time my fiance' is working, is not volunteered by himself. He is required to stay out as long as the rest of his work crew stays out, as they all ride in one work truck.

So if he's out working everyday for 12-15 hours, 6 days a week, how is that his fault that he is getting over time???

He has tried to tell his boss that he would cut back on some days to roughly get his 40 hours, but his boss says that he 'needs him to work'.

So I guess my question is, can this boss legally not pay him his time and a half if he works over time? This just doesn't seem right to me!

Oops. I answered this same post on another board, not this one. The answer is the same, Kari. Your fiance must be paid time and a-half for his OT hours.
