What is the name of your state (only U.S. law)? vt...my co-worker is going bankrupt and we were all wondering if someone is overdrawn at their bank, mainly due to overdraft fees, can she go bankrupt on that? I and another didn't think she was protected in a bankruptcy owing a bank money since she was responsible for the overdraft. Others disagreed. So does anyone know if bankruptcy allows someone whom is overdrawn say by 400.00 or more to add that as a forgiven debt? I would think she could not. Thanks, Faith.

There is nothing in the bankruptcy code the says overdraft fees cannot be discharged in a bankruptcy. There will also be a very good chance the person will not be able to open a checking account for several years because of it.
