What is the name of your state? Kentucky. Is there a statue of limitations on an overdrawn checking account in the state of Kentucky? Can a third party sue you or does the Bank have to sue you?

15 years on a written contract. The bank could sue you, a third party could sue you on behalf of the bank or if they bought the debt, a third party could sue you in their own name.
