Our parenting agreement states "We agree that we will not allow a new partner to stay overnight when the children are in the house, until there is a remarriage." I am getting married in less then 4 months and want to have my new spouse move in prior. If my ex doesn't like this... what can he actually do about it. We reside in Massachusetts?

He could file contempt charges against you for violating a court order.

Is this a common clause to be able to have put in a custody agreement. I am in New York, presently do not have an agreement, but we are woring towards one and would like to know my chances of having an order such as this put into our agreement.
Any suggestions or assistance would be greatly appreciated.

It's not a standard clause, but you certainly have the right to ask for its addition to your custody plan. If both parents don't agree on the clause, it would be up to the judge whether it's included.

this is why you really SHOULDNT have those kind of clauses. My husband's case is from Ma. and I bet if your ex pushed the issue for contempt, you could just come back with modification on the grounds of you're marrying in 4 months,(you look better if you modify first) and come away with a slap on the wrist if it came to that. Or just wait it out a few more months. The court doesnt really have time to deal with this stuff.

Make your life a living hell and then make you pack suitcases when you lose custody of the children.
