I was laid off from my previous job at a dot com. They overpaid one of my final severance checks and I was wondering what recourse they may have to get it back. I have direct deposit and the money has been transferred to another account because I'd rather not have them dig through my account to get it. I realize it's not mine but if I can keep it I'd like to.

Overpayment

Although you are correct that the money is not yours; however, they have no legal access to your bank account. To get the money back they can sue you, then attach your property or wages.
