What is the name of your state (only U.S. law)? Wisconsin.

I was recently on short term disability due to an illness. This is an employer provided benefit. Our HR folks meglected to take me off the regular payroll for two weeks and "overpaid" me. Now they are deducting my pay so I can pay them back. The question is am I legally obligated to pay them back for their mistake?

Yes, you must pay it back. And if you refuse, they can sue you for it. And they'd win. Just because the employer made a mistake doesn't mean you get to benefit from it. If you overpaid one of your creditors, wouldn't you want it back?

It doesn't matter whose mistake it was. There is nothing in the law that exempts you from paying back money that you did not earn and are not entitled to. Regardless of who made the mistake.
