I have a question concerning overtime pay when on call.

I work in Virginia at an apartment complex and sometimes I have to be on call after hours to answer emergency calls such as water heater leaks, burst pipes etc.

I'm told when on call, I must available to respond quickly.I do get paid for the time when I have to go out to an emergency.
My question is since I have to wait for pager calls that may occur, should I get paid for just "being on call" even though I may not get paged? I have to be on call for 72hrs. every other week.

I do not know about VA but in most states it is not compensable work, but a term or condition of employment. If it was work then every on call employee would exceed the Federal hours guideline and be entitled to overtime..

It is possible that you might be due compensation for you on call status. I recently called the Dept of Labor in my state (CA) and they had a whole description of what would be compensable and non-compensable for people with on-call status. I'm sure your state should have similar information. You should call the Dept. of Labor and listen to the recordings on the subject if they have them.
