South carolina, we have a legal seperation in force which i am currently trying to get overturned, as i have since found out he was commiting adultry, so i now want possesion of our marital home and alimony. only married 5 years no kids but i lost my daughter last may, she died in the house and is buried on the property.what chances and any other advice as to your opinion on my this matter? he has moved her into the house also which happen just three weeks after i moved out, thinking it was just temporary. thanks and whatever other advice you have for me? ginniehall

My response:

All you need to do is re-file your original Petition of Legal Separation, and change it to Dissolution. See an attorney for specific procedures.
