California, A friend of mine borrowed money from me last December 2000. Until now, I have not received any payment. The person's excuse was that the person that signs the check was out of country (the borrower has a business account)and that as soon as the person arrives to United States, the money owed will be paid. During January to the present time, I have e-mailed, called, paged and talked to the person but the person always have an excuse (the check signer is not home yet)or just would not return my call/page or answer my e-mail. The check signer came home June 28, 2001, and now the borrower is saying that the check signer is in different city, and will pay me when the person gets back in Los Angeles. I have called so many times to ask when the person will get back to Los Angeles and the borrower keeps saying he/she has not talked to the person yet. I feel like the borrower is giving me a round around, what should I do? Can I bring the borrower to court to go after my money, its not a lot but I worked hard for it. Please advice, I really need it desperately.

P.s. All the borrowed money was given to the borrower by cash so I don't have any statement/document showing I gave the borrower the money. Would I have a case in the small claims court anyways?

This one is really pretty simple. Take them to Small Claims court. They will then have to pay the amount, plus your actual costs.
