Owner is Selling the House I rent.

I'm simply trying to find out if I have a case or not. My situation is that
I am currently renting a house. My landlord/owner contacted me to say that
she is selling the house. She claims that if someone buys it to live in it,
we will have to vacate, if someone buys to rent it, we would be signing a
new lease with them (under there new conditions). On top of this, she
refuses to break our lease so we can find somewhere else to live, rather
than just wait for someone to come and buy it. In the meantime, she has
potential buyers browsing through our house while we are at work. Any
insight into this would be fantastic.

Your lease is assumed by the purchaser of the house. Meaning until your contract runs out you are the new owners tenants.

They can of course offer to buy your lease but then you have the right to negotiate. Stuff like yes we will go but you pay our moving expenses etc.

Tell your current LL to do some research on LL/tenant laws.

She has to give you reasonable notice to bring people into your home to look at it also. What is reaonable notice is the question. Some people say 12 hours some say 24 hours notice. Either way she cannot just come into your home during the day without notice.

In short, your LL can sell the house while you reside in the unit without your approval...

However, if you are on a lease, the LL CANNOT terminate your lease as it will carry over and be come the responsiblity if the new owner of the house, and the new owner will be your new LL... You do NOT have to sign ANY new lease with the new owners of the house...

Your existing LL MUST give you reasonable notice to show your rental, look at your states LL/T laws to see how much notice is required...

Thank you to all who have replied so far. I guess my question now has developed from many people telling me that if my LL does sell the house, we still have the right to live there until our lease is up. Is there anything protecting us from her showing the house at all? I hate to live in a place that I have to clean up simply because she calls to say she will be showing the house in 24 hours (sometimes you just don't feel like cleaning ya'know!) Not to mention that random people who 'drop in' just because they see the sign out front. I have heard many different things now so let me just ask this:

TRUE OR FALSE
1) With or without notice, if she wants to show the house, we can deny her.
2) She can activily advertise the house as 'for sale'
3) If an investor buys, they have the right to form new conditions such as raising rent.

Once again, I am a resident of Boise, ID

I basically just want to go back to life as normal, just finish out my lease and get out. I don't believe that she may be informing people that we have a lease and we could be here for the next year!

Any tips/tricks I could use just to get things back to normal? Thanks again for all responses!

No, it is her house after all.

You don't have to clean it if you don't want, as long as there is nothing in your lease stating so.
Not to mention that random people who 'drop in' just because they see the sign out front.
You do not have to show the home to these people. The LL or RE agent is the only people with any rights to view. All others need to be accompnanied by one of the two.

Go with the flow and live with it the best you can. There really isn't much you can do.

Just wanted to let everyone know that I was able to get my LL to break the lease so we could escape and just get on with our lives.

.....As far as the potatoes, your uh..on your own. Actually i've been all over Idaho, and I have yet to see a single potato field! Anyway, thanks for the help guys!!

Gee, if the potatoes aren't really from Idaho, can I sue the distributors for false advertising or false representation?:D just kidding

Would that be "my own private Idaho" as in "state of" or just "potatoe"? They do generally cost more than the russets.

Amen to ENASNI's advice of "get it in writing". You just never know what might happen.

Get it in WRITING, as it is VERY common for a LL to tell someone they have been released from the lease only to turn around and sue the tenants in court for breaking the lease...

They letter should state that you are released from ALL clauses of the lease, and there will be NO claims brought against you...

You can tell the LL you will NOT leave until you have the release form...
