I live in a townhouse community in PA w/ homeowner's association. Bought house 11 years ago, and basement window well would fill up w/ water and come into basement. Builders put in drain system from all of area window wells to a main pipe which empties into an underground french drain. In the last 2 years, when it rains extremely hard, water backs up through drain, fills up window wells, and wants to come in basement window. Who is responsible to fix this? The homeowner's association or me? This affects all homeowners tied into this drain system. Homeowner's association says they are not responsible. What is my next step? If I file against association and they have to fix it, will they pay my legal fees or will I have to pay. Thanks for any help with this.
