Hi IAAL and Leagle Beagle,
On the subject of the antique tractor, I still don't know what to do next. We've established that there is no title to the tractor, it was acquired during my marriage and I did consider it my husbands until he's left it here and neglected to take care of it or even check on it for over 2 years. Maybe the question is , if this was acquired during the marriage does it belong to me as well as him ? I have no way of proving ownership , just like the used computer I'm typing on , there is no receipt, it's mine, it's in my house but other than that fact I have no proof. The tractor was brought here from Michigan when his father died, along with some tools and other odds and ends , we went up there and helped clean up the house so it could be sold and this is the stuff we brought back to NC with us. There were stocks, bonds, etc. that were divided up between the children, and I suppose the proceeds from the sale of the house, although I don't have the details on those things, I know he did receive dividend checks from some of the securites, a couple of times he let me have the check to use for something needed, but otherwise it has all been his. If I contact him about this tractor he'll just say it's his and he'll come and get it. So, is it my tractor too ? Can he have me arrested and charged with stealing if I sell it ? I haven't asked for anything else , pesion, stocks, etc. even though some of this was acquired while we were married, wer'e still married , so I am also owner of this tractor ? I can use the money to catch up bills but I don't want to get into trouble over it. We were only together for about 5 years so I didn't feel like I had a right to his pension since I wasn't there all those years he'd worked for it, so I do want to be fair but fact is he's just left it, neglected it, and I could really use it. I'm sorry to keep bugging you, I just can't afford a lawyer for this, it's been two years of struggling just to keep from losing my home and I'm just beginning to be able to make it from week to week without borrowing from my mom. Honestly , no I haven't contacted the DMV, don't know what state you're in but the DMV here is a joke, ok, the DMV employees are usally not the brightest lights in the building. But the holidays are over and I will contact them and see what they say, I will ask them if I need to get a title for the tractor and how I would do this if I need one. But it comes down to the same thing, I don't have any "proof" that the tractor belongs to me. Thanks, Oobie
