What is the name of your state? california

I believe that my X is trying to turn my daughter against me. I have recorded conversations between my daughter and I that seem to point to that. She accuses my wife and I of things that make no sense, is angery toward me, and obviously has been coached on things to say to me. I am pretty sure that I can record conversations between my child and I and admit them as evidence. However, I am worried about how succesful I will be persuing pas. Has any lawyer or parent ever gone to court be accused of or accusing their X of pas? If so please let me know how it turned out, and any tips you might have.

California is a two party state - which means that *both* parties participating in a phone call must give their consent to the recording. I'm not certain that a minor child can give that consent. So you'd be well advised to discuss the legality of your taping.

As for PAS, my understanding is that many judges feel it's an overused claim w/o enough basis. You may want to check at www.deltabravo.net for more info.

Anyway here's my response.

I FOUND it is the attorney you retain makes the case. My atty is well aware of Divorce Related Malicious Mothers Syndrome aka P.A.S.

Retain the BEST attorney in your area regarding Family Law.
Ask around for attorney recomendations. See whos name pops up the most. Call the clerks office and make small talk on who they see in action the most agressive.

Then have a meeting with your prospective attorney. Hammer home your importance of P.A.S. Their reaction will tell you wether you want to retain them or not.

Don't worry about pissing off the attorney by being so direct. Attorneys like a client who wants to get down to business and NOT an emotional basket case. Stay professional.

I have retained a LEGAL TEAM. How would you like my bill? MY case is so involved with excessive litigation and contact denial, I needed more than one attorney. The grand finali of my case burst open next month. My case may make case law regarding P.A.S. I have retained a seperate Bankruptcy Attorney just investigating the bankruptcy added into my child support and illegal garnishments. It was well worth it because they will present law that will allow me repayment, back credit, and damages.
