paid deposit, didnt pick up item

In October, I was given $85 as a deposit for a computer. Computer was completed in December. I have contacted person in December, January and February. Each time he is not ready to receive the machine. The computer still sits in my living room, nearly 6 months after completion.

After all this time, has this person lost any claim to his deposit? Computer is doing no one any good at this point.

My response:

As we all know, computers become "antiquated" more and more with each passing month. A six month old computer, keeping in mind that this technology is "moving at the speed of light", can have deleterious affects on the resale value to a third person, as compared to the "contract price", i.e., you may not be able to recoup all of your parts and labor investment under your current contract pricing structure when the same is sold to a third person.

Therefore, you really need to take your written contract to Small Claims court and sue the other party for the contract price.

Oh well. Guess I just sell it and build another if/when i am contacted. I do believe I have made a good faith effort to complete this transaction.
