Paid deposit

If a person were to pay a deposit on a rental that would not be ready to move into for a few weeks.
And then the person decided they did not want to move from where they were living.
And told the complex manager that they didnt want the place before it was ready,at least 5 days.
Are they allowed to keep the deposit.
