paid for an item via the internet but the goods were never sent

What is the name of your state? Hi, I live in Va but the goods were to be shipped from FL. What happened is an item didn't sell on ebay. I spoke via email with the seller and we agreed on a price and I sent her a money order which she admitted she received but now even though she claims she sent the luggage I don't believe her and I haven't received it after 3 weeks. She didn't use any tracking and her stories have become inconsistent which makes me believe she is lying. At this stage I want my money back because i wouldn't believe the item to be authentic now. In addition, she has since deleted her profile from ebay.
My question is do I have to hire an attorney in her state to subpoena her? What are the next best steps I can take to recover my money.
We've corressponded via emails so I have the whole trail.

Have you corrosponded with EBay re this?
Has the cashier's check been cashed?
Exactly how did she send it? When was it shipped?
Remember the phrase, " Caveat emptor : - Let the buyer beware. (He buys at his own risk) Well....
"Caveat-Emp~tor"

You now question the credibility of the seller?
An article in the Sunday New York Times took an in-depth look at the problem of counterfeit merchandise being sold via online auctions. The paper reported that Tiffany is suing eBay, claiming the auction site facilitates counterfeiting. It seems Tiffany secretly bought about 200 pieces of jewelry via eBay in 2004 and found that three out of four items were fakes.
