What is the name of your state? massachusetts
recently i purchased a ford conversion van from a private party.i paid cash for the vehicle. i went to pick up the van and it was gone.i went to the house that i thoght the people lived at, and come to find out they moved out of the nieghborhood a month ago. but i had just been there less than 48 hours ago. i called the number that i had gotten from the ad in the want ad. the woman answered that i purchased the vehicle from.she told me that she had taken the plates off and it was left on the street.come to find out it was impounded.they wanted 115.00 to get it out and the registration.i told them i wanted my money back.the husband told me that he did not want to do that and that it was my problem.i still have not gotten the vehicle.because it is a long wkend and the rmv is not open.my ? is do i have a leg to stand on if i take them to court?

thank you for responding. i purchased the vehicle on 11-8-02 and went to pick it up on11-9-02
again thank you any advice would be helpful

My response:

Pay the impound fees. Get your van.

Immediately from the impound lot, go to your nearest Small Claims court and file a breach of contract action and damages (the amount you paid the impound yard).

You see, when you purchased the van, and they agreed to "hold onto the van" until you picked it up the following day, they created what is known in the law as a "bailment" - - a type of contract. They had a duty to safeguard the vehicle and not cause you any damages.
