He doesn't ever "HAVE" to repaint. He will probably repaint for the next tenants and since you've been there so long he won't be able to deduct from your deposit as it will be normal wear and tear.

However, have you asked him if he would be willing to repaint? Better yet, ask him if he will buy the paint, let you paint it and give you a break on the rent for your labor.
